Why joint tenancy risks real estate inheritances in Indiana

Adding a child or another heir to a deed as a joint tenant may avoid probate, but it can also create new risks for the person making the transfer and their family. In Indiana, joint tenancy can expose the home to another person’s creditors, divorce problems and tax consequences that many families do not expect.

Joint tenancy gives another person real legal rights

A joint tenant does not just inherit later. Once someone signs the deed, the added party gains present rights in the property, not just a future inheritance, which is a key feature of this form of ownership. That matters because a parent who adds an adult child to the deed may also expose the property to that child’s financial problems.

What risks can come with adding someone to the deed?
